We will use reasonable care and skill when providing services. Project outcomes may depend on site conditions, existing structures, access, materials, weather, third parties, client instructions and information supplied to us.
Client Responsibilities
To allow us to deliver services properly and safely, you are responsible for providing cooperation, accurate information and suitable access.
Unless otherwise agreed in writing, you are responsible for:
- Providing accurate project information, drawings, measurements and specifications.
- Ensuring that you have authority to instruct the works.
- Obtaining any necessary permissions, licences, building control approvals or landlord approvals.
- Providing safe and reasonable access to the site.
- Informing us of known hazards, asbestos, structural issues, underground services or access restrictions.
- Ensuring that the work area is ready unless preparation is included in our agreed scope.
- Making decisions, approvals and payments within agreed timescales.
- Keeping children, pets, visitors or unauthorised persons away from work areas.
Site Access And Conditions
You must ensure that we have suitable access to the site at the agreed times. This includes access for workers, tools, vehicles, equipment, materials and waste removal where required.
Site conditions can affect our ability to start or complete work. Examples include:
- Unsafe structures or unstable ground.
- Restricted parking, loading or unloading access.
- Locked areas, missing keys or unavailable site contacts.
- Undisclosed asbestos, hazardous materials or contamination.
- Unmarked underground services or hidden pipes/cables.
- Poor weather affecting external work.
- Other trades or contractors preventing access to work areas.
If access is not available or site conditions are unsuitable, we may need to delay the works, revise the programme, charge additional costs or suspend the project until the issue is resolved.
Pricing, Deposits And Payments
Prices will be set out in the relevant quote, proposal, invoice, purchase order or contract. Prices may be fixed, estimated, day-rate based, stage-based or otherwise agreed in writing.

Unless stated otherwise, prices may exclude VAT, specialist surveys, statutory fees, permissions, third-party charges, skip permits, parking permits, congestion charges, access equipment, disposal of hazardous materials and additional works outside the agreed scope.
Changes, Variations And Additional Work
Any change to the agreed scope, materials, specification, design, programme, site access or working method may affect the price and timescale.
Variations may arise where:
- You ask for additional work or changes to the original scope.
- Hidden defects, damage, unsuitable surfaces or structural issues are discovered.
- Measurements, drawings or specifications supplied are inaccurate or incomplete.
- Materials are changed, unavailable or substituted with agreement.
- Site access, working hours or programme requirements change.
- Additional health and safety controls or specialist support are required.
Where practical, we will confirm variations in writing before carrying out additional work. Urgent safety-related work may need to be addressed immediately.
Delays And Events Outside Our Control
We will aim to meet agreed timescales, but dates may be estimates unless confirmed as fixed in writing. Construction and refurbishment projects can be affected by practical issues outside our control.
We will not be responsible for delays caused by events outside our reasonable control, including:
- Bad weather affecting external works.
- Material shortages, supplier delays or delivery issues.
- Client delays, late approvals or changes to instructions.
- Restricted access, parking or unavailable work areas.
- Other contractors, trades or third parties causing delays.
- Unexpected site conditions, hidden defects or hazardous materials.
- Power cuts, utility issues, accidents, illness or emergency events.
Where delays occur, we will aim to communicate with you and adjust the programme where reasonably possible.
Materials, Products And Client-Supplied Items
Materials may be supplied by us, by you, by a main contractor or by a third-party supplier depending on the agreed scope.
Where we supply materials, we will aim to use suitable products for the agreed purpose. Where you supply materials, you are responsible for ensuring that they are correct, available, suitable, undamaged and delivered on time.
- We are not responsible for defects in client-supplied materials.
- We may charge for delays caused by missing or incorrect materials.
- We may refuse to install unsuitable, unsafe or damaged materials.
- Colour, finish and product variations may occur between batches or manufacturers.
- Manufacturer warranties are separate from our workmanship obligations.
Health, Safety And Site Rules
Health and safety is an important part of our work. We may prepare or follow risk assessments, method statements, RAMS, site rules, induction requirements and client procedures where required.
You must tell us about known risks, including:
- Asbestos or suspected asbestos.
- Structural instability or unsafe areas.
- Underground services, hidden pipes or live cables.
- Hazardous substances, contamination or biological hazards.
- Restricted access, fragile surfaces, confined spaces or height risks.
- Occupied premises, vulnerable persons, children, pets or public access.
Quality, Workmanship And Defects
We aim to complete works with reasonable care and skill and in line with the agreed scope. If you believe there is an issue with our workmanship, you should notify us as soon as reasonably possible and provide clear details, photos and access for inspection where needed.
We will not usually be responsible for issues caused by:
- Normal wear and tear.
- Misuse, neglect, poor maintenance or accidental damage.
- Existing defects, damp, movement, rot, contamination or structural issues.
- Client-supplied materials, products or instructions.
- Work carried out by other trades or third parties.
- Failure to follow aftercare, drying, ventilation or maintenance advice.
Where a valid workmanship issue is identified, we will aim to agree a reasonable solution, which may include repair, correction or other appropriate action.
Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.
Subject to the above, we will not be responsible for indirect losses, loss of profit, loss of business, loss of opportunity, loss of goodwill or losses caused by inaccurate information, client delays, third-party contractors, hidden defects, site conditions or events outside our reasonable control.
Our liability may be limited to the value of the relevant contract, the amount recoverable under insurance or another amount agreed in writing, depending on the project and applicable law.
Cancellation, Suspension And Termination
Cancellation rights and charges may depend on the type of client, the type of contract, the stage of the project and whether materials, labour, subcontractors or dates have already been committed.
We may charge for:
- Work already completed.
- Materials ordered or supplied.
- Non-refundable supplier costs.
- Booked labour, subcontractor or plant costs.
- Administration, design, planning or preparation work already carried out.
We may suspend or terminate work if payment is overdue, access is unavailable, site conditions are unsafe, necessary information is withheld, instructions are unclear or there is a serious breach of the agreed terms.
Photos, Portfolio And Intellectual Property
Unless agreed otherwise, website content, branding, text, images, layout, graphics and business materials belong to us or our licensors and must not be copied or reused without permission.
We may request permission to take photos or videos of completed works for records, portfolio, website, social media or marketing purposes. We will not intentionally publish confidential information or personal details without appropriate permission.
If photos are not permitted on your project, you should inform us in writing before work begins.
Complaints And Disputes
If you are unhappy with any part of our service, please contact us as soon as possible so that we can review the issue.
